So, pulling into a church parking lot at 1:00 a.m. is probable cause for the police to pull you over?

It's always good news when the police can make an arrest of a felon who is in possession of a firearm and ammunition. However, if the news story below is accurate, the police didn't have any grounds for arresting this particular felon (i.e., probable cause). Don't get mad at the judge with this person is right back out on the street.

 

 

Night out on birthday ends with morning in jail

Jachion A. Johnson, 23, of 1725 N. Broadway St. was arrested at 1:01 a.m. Thursday and booked on charges of possession of drug equipment, possession of marijuana, escape, obstructing police, possession of a firearm by a felon, unlawful use of a weapon, possession of ammunition and criminal damage to property.

Johnson was seen exiting a vehicle in the parking lot of Laramie Street Baptist Church, 1611 S. Laramie St. A Peoria County Sheriff’s Department deputy approached Johnson and asked if he had anything illegal. Johnson reached for his left-front pocket, and the deputy put him in handcuffs.

A short time later, Johnson freed himself from the handcuffs and ran into the backyard of a house in the 3000 block of Fremont Street.

A deputy cornered Johnson as he tried to climb a fence. Johnson began to fight with the officer and was Tasered twice before being put into custody. Police found a sawed-off shotgun and ammunition in the trunk of the vehicle Johnson was driving.

He told police he ran because he didn’t want to go to jail on his birthday, which was Wednesday.

So if someone (a stranger) pulled into your private parking lot (ie driveway), parked, and got out of the vehicle, at one in the morning; you would not be concerned?

Not to mention the fact that RAN away from the police. People that have done NOTHING wrong have NO reason to fear the "popo". Perhaps by arresting this individual, the police kept someone ALIVE last night....

I hate seeing both sides of an issue--but I often do and so it is with this case. Yes, the police should have cause--and not just a presumption of guilt of some sort. Perhaps this young man was going to do something criminal, but he was arrested before he did it--not exactly justice, is it? Emerge's point was not to excuse the young man's behavior but to point out he will be back on the streets because procedure/protocol/justice was not followed.

I remember several years ago, I was a designated driver. We pulled out of a bar in East Peoria, a police officer immediately followed me. I pulled into a gas station to get milk to take home. He immediately ran up to me and got in my face. I asked him if there was something wrong, and he said, "no, you are not who I thought you were." I replied and I don't have alcohol on my breath either, I had nothing to drink tonight. The other three people in my car were drunk, but legally. I also told him, I didn't mind if he was fishing. He left. Didn't taze me or anything. I know that this is different, but it is how the police operate. If they don't do their jobs by their guts, we would have never caught Al Marri, the alleged terrorist.

I know that I will probably get beat up for this but...on the south side of Peoria, where I grew up. Pretty much most of the violence there is black on black. Probably because most of the residents are black. Makes sense doesn't it. If they were all Chinese, it would probably be yellow on yellow violence. But, if you are a young black male out at one a.m. there is a good chance you might be doing something wrong. (I am not saying that it is right, just probable.) And that fact that this young man, like many young people today, have little or no respect for the law, (whether the deserve it or not), when a police officer ask you to do something, you should comply. He or she might be in the wrong, but at that particular time, running and fighting is not the right answer. This young man should not have had drugs on him. He should not have ran, and he difinately should not have fought with the police. His birthday had nothing to do with it. I was pulled over by a police officer, and we were both the same color. He claimed I ran a red light. I did not, I made a right turn, and I probably didn't make a complete stop. He kept me there for 45 minutes. He told me that my license didn't look like me. I joked, whose does. He got angry and asked me if I wanted to go to jail? I said no. Later I talked to a policeman that I am friends with and he said this man does that all the time and if you report him he will look for you and make your life hell. So, I swallowed hard and paid the ticket and kept my mouth shut. Did I do the right thing? I guess so.

And when confronted by a police officer he reached for his pocket. I am guessing the officer didn't say empty your pockets.

So... wrong place, wrong time, and pulling something out of his pocket without the officer 'ok'ing it.

I am not seeing the other side of this.

Mahkno, in this day and age, I really don't believe we can expect police not to jump to some rather logical conclusions--so, I do not fault the police so much in this case. However, the truth is that the law, as Emerge points out, has enough loopholes so that the young man probably could have a case for harassment.
As far as not having a valid reason for being in a church parking lot, that depends on what church. I go to First United Methodist Church downtown where all manner of things go on at night in its parking lot. :)

At 1 a.m. at First Methodist on Main Street across the street from bars that are open until 4 a.m.???
Custodians have to clean the parking lot early Sunday morning--beer bottles, etc.

My son is WHITE and he got pulled over in Peoria for NO REASON either. Guess what, he handed the police officer his driver's license and insurance card. 5 minutes later he was on his way home. Driving around late at night is a RED flag to the police. Let them do their jobs, keeping the city safe, if that means pulling someone over for "no reason", then so be it.

I work at a church, and I have often been there at 1 a.m. In fact, I was there at 1 a.m. Saturday night/Sunday morning getting reset for Sunday morning services after we had a late-ending concert. So yes, there are valid reasons.

Yep, a balding white man getting into his car in the church parking lot compared to a black man who has pulled into the parking lot at 1am. The lot in this case is located out on 91, where crime knows no bounds, which is why this church moved in the first place? Apples and oranges CJ.

BTW, how long before some innocent kid coming from a party gets run over by a car? I predict within a few weeks if things don't change.

Today's PJS has some very disconcerting crime stories of events on Peoria streets and in businesses. One brings Thrush Street back into the news--I guess no one is denying that this new event invovlving a large number of young people occurred.

You all act like you know him and what happened. How can you judge my brother based on words in a newspaper? I guess no one is innocent until proven guilty any more. His prints weren't on that gun ei.ther. And as far as being in a church parking lot at 1am...we are a religious family with member who have their own congregations. So before you try to judge someone based what you have read, get the trfue facts. My lily bro is a GREAT MAN & A GREAT DADDY to. His lil girl. I love you Bro and I am here for you. Everybody else needs to learn to be a little bit more open minded and not alwys think the worst of someone just because you read it in a paper.

How many conferences has this "great daddy" attended? Can he name his lil girl's teacher? Could his daughter's teacher recognize him if she saw him? Does he have any idea what grades she is getting in school? Seems to me a good daddy might not have drugs and drug equipment on him, not run from the cops, and not be riding around in a car at 1am with a sawed off shotgun in the trunk. But that's just my opinion...

He knows everything about his daughter. He has been there from the time that he found out that his girlfriend was pregnant. Since then he has been trying to turn his life around. As far as the "findings" in the trunk, he was unaware of and forensics have eliminated his involvement with it. The "REAL GUILTTY PARTY" needs to be a "REAL MAN" and step up instead of letting my bro take the fall for their ignorance. Like I stated in my previous post, we are a religious family with family that have their own congregations. So yes their is w reason to be in a church parking lot at 1 am. He may not make the best choices sometimes, but he has turned his life around because of his beautiful daughter. And now once again it all comes back to my previous post...Be more open minded. Why do people think the worst of a person just because they read it in the paper when they dont know the person it's about or the circumstances surrounding the situation ?

BTW...To answer you big question, here's a simple two part answer...1) she only 3 yrs old, and 2) up until that night, he has been to any and everything that has in that could possibly involve her. His life revolves around his daughter...

WELL FIRST AND FOREMOST. This is my brother you are talking about he is not a bad person the only reason why he RAN is because it was his birthday And he had no Idea. That gun was in his trunk boy he was supposed to be his friend told him in front of my face that he could Not get into the club with a white t shirt on So my brother took him to his grandmother's house to get a change of clothes The boy came out of the house with a book bag my brother assumed there were clothes inside of it. He told my brother to pop the trunk and the boy throws his book bag in the trunk and in the boo bag was the sawed off shotgun my brother had no idea about. No my brother is. Facing the federal charges and federal time over something he did not do or kno about this is not fair he has a family and a little girl to worry about he would never do something like this my brother does not deserve this. Check his f****** background And he had a fourth class felony 4 driving without a license And having a bag of weed and my brother has not smoked in over 2 years . The same boy that got him in this bull. now is the same boy that got him that felony charge with that weed But listen to the papers and people on the street I guess they know the most right. My niece turned 3 without her Saddam on Oct 30th she thinks he's at the studio ::( she waits n the window for him to get off work and take her home :( I hate this I wish he would. Just confess. My brother is an innocent man!
