The McArdle defense fails Mary Davis

It’s ironic that Mary Davis would attempt to use the actions (or inactions) of Julie McArdle as part of her defense. McArdle claimed that Davis and District 150 retaliated against her and violated her First Amendment rights when they tried to prevent her from speaking out about Davis’ taking money from the school. Quite a turn of events to now see Davis attempting to hang her defense on McArdle not speaking out in a timely manner.

Judge allows theft charges against D150 principal to stand

An area judge threw out a request by a former District 150 principal to dismiss charges alleging she stole money from the school district.

Peoria County Circuit Judge Timothy Lucas shot down arguments by Mary C. Davis that indictments handed down last year were barred by the statute of limitations and failed to pass muster for other legal technicalities.

Davis, 52, of Dunlap was charged in April 2010 with 16 felony counts of official misconduct and theft. The counts allege that while principal at Charles Lindbergh Middle School she took money several times between 2005 and 2007.

Davis' attorney contended at a hearing in September that prosecutors didn't file charges in time. At the crux of Davis' argument was that her successor at Lindbergh, Julie McArdle, waited too long to tell authorities, thus barring any prosecution.

But Assistant State's Attorney Seth Uphoff, at a hearing in September, assailed that notion, saying McArdle had no such legal duty to report to police and, regardless, charges were filed within a year of notification. That, the prosecutor said, satisfied any statute of limitations requirement.

Lucas agreed, writing in a two-page order Wednesday that McArdle was not a department or division head and had not been delegated such authority.

It appears that Ms. Davis is quickly running out of options. She is now on her third attorney and her "hail mary" attempt to have the case thrown out has failed. Hopefully this case makes it to trial so the public can see how she explains the financial discrepencies.

Funny. Davis doesn't ask for the charges to be dismissed for "lack of evidence" but because McArdle didn't tell on her in a timely fashion. How ironic and narcissistic is that? Hope she enjoys high-car prison food.

And remember, she bought a really expensive pen set, I think it was like a thousand dollars. With money she stole in essecence from the kids. I think I would be more compassionate if she need money for food, or gambling or a drug problem.

Actually, the pen set was "only" around $450.00. I think she bought it as a gift for someone. You know, she is a very "caring" person and loves to "splurge" on her nearest and dearest....isn't that true Fab Five or Six or Seven...lol

Didn't she, also, buy an American doll for one of the teachers from China. Start looking around at your schools--in the principal's office, in particular. Do you see expensive office appointments (potted plants, things on the desks, etc.)? Ask yourself who paid for those? Teachers "decorate" their rooms with their own money but I have a bit of a feeling that many who can write checks for school supplies can slip in nice little items to make their work environment a bit more attractive. It would be interesting to take a good look at the working environments on Wisconsin Avenue. Do any of those administrators have Ipads at District 150 expense? Do any teachers have them--I doubt it?

I worked in a school in D150 for many years and the Principal(I shall use that term lightly), more like a dictator, had a fabulous set of office furniture with a microwave in her office. Funny, the furniture in the classrooms was falling apart. I remember having my retired father come up with hammer and nails to try and salvage a bookcase that was nothing but ROT. She would have us fill out "wish lists" each Spring with what we needed in our classrooms....NEVER SAW ANYTHING. Always wondered where that money went. BTW, her activity fund was never audited when she left EITHER. D150 is a MESS. Many administrators are hired based on skin color, not on effectiveness and that, my dear, is the TRUTH.
P.S. I am not a racist, but a realist.

So do you believe that only administrators of a particular skin color have lovely office furniture, etc. I definitely disagree. You might be right about unqualified administrators--but I have definitely noticed that they come in all skin colors.

Wonder what she did with that $60 thousand PLUS she misappropriated. It is definitely more than a "bookkeeping" error Mary, even I know that.
